Terms and Conditions

The terms and conditions below are a legal requirement, and are a protection for you the customer, and of course for us as well! Once costumer books a tour or a service, by default costumer accepts these terms and conditions. Once ‘therometour’ confirms costumer\’s booking a contract is made between ‘therometour’ and the costumer upon the terms and conditions set out below. ‘therometour’ will only confirm costumer\’s booking once ‘therometour’ has received full payment for the tour or/and service.

BOOKING

Once booking and payment has been received by therometour, a confirmation email will be sent to the customer. The email is the confirmation of booking. All bookings are confirmed by email.

Therometour cannot be held responsible if customer provide an incorrect contact (email address or phone number). If confirmation does not arrive travelers must contact therometour at booking@guideyouitaly.com. We reserve the right to sell any places reserved without full payment or a deposit. It is the responsibility of the customer to check the accuracy of dates booked upon receipt of their travel documents.

PRICING AND PAYMENT

Prices confirmed at time of booking include all taxes and surcharges. Once costumer booking is confirmed and deposit or full payment is made, the tour price will not change. All Prices quoted on therometour are in Euros (€) and per person, unless otherwise specified. All payments and refunds are due in Euros. Therometour is not responsible for any changes in currency exchange rates that might occur from the time of booking until a refund is made. Costumer will be advised before booking if any pricing has changed. We accept all major credit cards. If customer prefer to pay with a bank transfer, please contact us at booking@guideyouitaly.com and send us all the information regarding the booking.

MEETING POINT

Costumer will be sent an email confirmation with meeting point details, which are also available for each tour at guideyouitaly.com. Costumer are asked to arrive to the meeting point 15 minutes prior to the start of the tour and/or service.

LATE ARRIVAL AT THE MEETING POINT

The tour and/or service will start at the time stated. If costumer is running late or need assistance in finding the meeting point, please call the number provided in confirmation email, therometour will do its best to assist you, however it is costumer responsibility to reach a meeting point on time. Please read the no show/late arrival clause on the cancellation policy.

PROMOTIONAL CODE

Costumer in possession of a coupon code or qualify for a discount, must apply for it before purchase the tour and/or the service. Therometour cannot apply any retroactive discounts. Promotional codes cannot be combine, cumulate, transferred or re-used. All promotional codes have an expiration date set at 1 year from issuance when no date is explicitly noted.

TRAVEL INSURANCE

Personal insurance is not included in the prices of theromeotur\’s tours and services. Therometour strongly recommends costumer arranges travel insurance to cover cancellations and delays due to unforeseen circumstances, or those beyond all control (e.g. inclement weather, strikes, seismic events). It is also recommended costumer arranges medical and personal insurance to cover any medical expenses, loss of baggage, loss of personal belongings, or other such travel mishaps. Costumer agree both the company and any local partner operators are not liable for any of such unforeseen circumstances, and hold both parties harmless. All claims to reimbursements for insurance must go directly through the insurance provider, and not through therometour or its affiliates.

CANCELLATION

Canceling or amending a booking with therometour can result in cancellation/amendment fees being applied by therometour, as outlined on our cancellation policy. Any cancellation/amendment of costumer\’s booking must be in writing by email to: info@guideyouitaly.com. A booking is considered successfully canceled or amended only after company sends successful notification via email and cancellation/amendment fees are assessed.

REFUNDS ON UNUSED SERVICE

Therometour doesn\’t not offers partial refunds for portions of a tour and/or a service that a costumer has decided not to take part or to use . If a costumer has pre-purchased tickets to any sites visited, or tours or site visits similar to the tour booked from an outside vendor, therometour is not responsible/liable for the reimbursement or prorating of any such fees.

FORCE MAJURE

If a site, attraction, or visit on costumer\’s schedule tour and/or service is closed due to force majeure, including strikes or other unforeseen closures, therometour will do its best to contact costumer as soon as possible, and offer a suitable substitution, reschedule a different service, or provide a refund, pending availability and at full company discretion.

WEATHER CONDITIONS

Under no circumstances therometour can be held responsible for weather conditions. No ticket can be cancelled or amended by the costumer at any time on the basis of weather conditions. We accept no responsibility for weather conditions that may affect the delivery and implementation of our tour and/or services.

YOUR OBLIGATIONS AND RESPONSIBILITIES

Costumer must informs therometour in writing by email to: info@guideyouitaly.com, of any medical condition that’s requires attention or medication before the tour commences.
It is costumer responsibility to have all necessary visas, passports, and I.D. on him on the day of the visit. It is particularly important for costumer who have qualified for a reduction based on age or student status. Students should bring a valid photo ID to every tour.

When costumer book with therometour, accept responsibility for any damage or loss caused by the costumer. Full payment for any such damage or loss must be paid at the time direct to the owner or manager or other supplier. If costumer fail to do so, costumer will be responsible for meeting any claims (including legal costs) subsequently made against therometour as a result of costumer\’s actions.

PUBLICITY, MEDIA AND COMMERCIAL RECORDING AND FILMING

During the tour the tour guide and/or the tour leader may take photographs and videos of costumer (as part of a group) and these may be used by therometour for brochures and/or advertising and publicity material on therometour\’s site and/or third parties\’ sites without obtaining any further consent or payment in respect of such photographs and/or films.

LIABILITY

Therometour encourages you to read carefully. This affects your legal rights. I (the party agreeing to these terms and conditions by reserving, purchasing, and/or participating in the tour and/or service) hereby waive any and all claims I may have now and in the future, and release from all liability and agree not to sue therometour, its officers, agents, representatives, employees or tour guides for any personal injury, death, property damage, or loss sustained by me as a result of my participation in the tour due to any cause whatsoever, including without limitation, negligence on the part of therometour, its staff, tour partners, or other participants, or death or injury as a result of war, civil unrest or epidemic. I further agree that if I violate this agreement and attempt to bring suit against any part of parties named herein, that I will be held responsible for attorney’s fees and any costs incurred by that person in defending such action. I am fully aware of risks and hazards connected with the activity, including but not limited to the risks as noted herein and I voluntarily assume full responsibility for any risks of loss, property damage, or personal injury, including death, that may be sustained by me, or any loss or damage to property owned by me, as a result of being engaged in such an activity. I am aware that the tour, in addition to the usual dangers and risks inherent, has certain additional dangers and risks, some of which include: physical exertion for which I may not be prepared and weather extremes subject to sudden and unexpected change. I accept all the inherent risks of the proposed tour and the possibility of personal injury, death or property damage or loss resulting there from. I agree that if I suffer injury or illness therometour or its staff can, at my cost, arrange any medical treatment and emergency evacuation service as it or they deem necessary for my health and safety. I understand that therometour will not be responsible for any medical costs associated with an injury I may sustain. I also understand that I am responsible for any damage I cause to the employees. Further, I agree at all times during the tour, to abide by and comply with any additional instructions given by my tour guide or any other therometour staff and I accept that non-compliance may result in injury, death or permanent disability. As a participant on the tour, I accept full responsibility for my behavior, well-being, and health throughout the tour, which may involve a variety of activities, unfamiliar locations, and modes of travel. I agree to hold neither therometour nor its staff liable in any way should any harm come to me. I further hereby agree to indemnify and hold harmless the releases from any loss, liability, damage or costs, including court costs and attorney’s fees, that may incur due to my participation in said activity, or not, whether caused by negligence of therometour or otherwise. I confirm that, by my own free will, I have read and understood the Terms and Conditions of the tours and services and agree that this Waiver and Release will be binding upon my heirs, next of kin, executors, administrators and successors. By purchasing the tour, I affirm that I have fully understood and agree to these Terms and Conditions, Waiver and Release of Liability.
